মোল্লা জসিমউদ্দিন, একবছর – দুইবছর নয়, প্রায় আটবছর পর কেন্দ্রীয় আইনে রিয়েল এস্টেট সংক্রান্ত আপিলেট ট্রাইবুনালের চেয়ারম্যান পদে নিয়োগ হলো সম্প্রতি।রিয়েল এস্টেট আইন নিয়ে কেন্দ্রীয় বনাম রাজ্যের সংঘাত চলছিল এতদিন। সুপ্রিম কোর্টের প্রধান বিচারপতির ডিভিশন বেঞ্চের রায়দানে গত ২০ মার্চ রাজ্যপাল ওয়েস্ট বেঙ্গল রিয়েল এস্টেট আপিলেট ট্রাইবুনালের চেয়ারম্যান পদে নিয়োগ করেন সদ্য কলকাতা হাইকোর্ট থেকে অবসরপ্রাপ্ত বিচারপতি রবীন্দ্রনাথ সামন্ত মহাশয় কে। মাত্র দু মাসের মধ্যেই বেশ কিছু মামলার কার্যকরী রায়দান করেছে এই আপিলেট ট্রাইবুনাল ।জানা গেছে গত ২০১৬ সালে কেন্দ্রীয় সরকার রিয়েল এস্টেট সংক্রান্ত ট্রাইবুনাল (রেরা) গঠন করে থাকে। দেশের সর্বত্রই চালু হলেও এই রাজ্যে গত ২০১৭ সালে রাজ্য সরকার নিজস্ব আইন (হিরা) গঠন করে। রাজ্যের রিয়েল এস্টেট আইন কে চ্যালেঞ্জ জানিয়ে সুপ্রিম কোর্টে মামলা দাখিল হয়।গত ২০২১ সালে ৪ মে সুপ্রিম কোর্টের প্রধান বিচারপতি চন্দ্রচূড় এর নেতৃত্বধীন তিন সদস্য বিশিষ্ট ডিভিশন বেঞ্চ রাজ্যের রিয়েল এস্টেট আইন (হিরা) কে ২৪৫ নং ধারা অনুযায়ী অসাংবিধানিক ঘোষণা করে। সেই সাথে দ্রুত কেন্দ্রীয় রিয়েল এস্টেট সংক্রান্ত ট্রাইবুনাল রেরা গঠনের নির্দেশিকা জারি করে। ওই বছরের জুলাই মাসে রেরা গঠনের বিজ্ঞপ্তি জারি করে রাজ্য সরকার। তিন সদস্য বিশিষ্ট এই বেঞ্চে বিচারবিভাগীয় সদস্য হিসাবে ২০২২ সালে ৩০ ডিসেম্বর প্রাক্তন বিচারক গৌড়সুন্দর ব্যানার্জি এবং প্রশাসনিক সদস্য হিসাবে আইএফএস ডক্টর সুব্রত মুখার্জি গতবছর ২০ ফেব্রুয়ারিতে নিযুক্ত হন।তবে চেয়ারপার্সন পদ টি শুন্য ছিল এতদিন। গত ২০ মার্চ রাজ্যপাল নিয়োগ করেন কলকাতা হাইকোর্টের অবসরপ্রাপ্ত বিচারপতি রবীন্দ্রনাথ সামন্ত মহাশয় কে। চেয়ারপার্সন নিয়োগ হওয়ায় ওয়েস্ট বেঙ্গল রিয়েল এস্টেট আপিল ট্রাইবুনালের গতি ক্রমশ বৃদ্ধি ঘটে।বিচারপতি রবীন্দ্রনাথ সামন্ত গত ১৯৮৭ সালের ব্যাচের জুডিশিয়াল অফিসার। ১৯৮৮ সালে নিম্ন আদালতে বিচারক পদে দায়িত্বভার গ্রহণ করেন।পরবর্তীতে কোচবিহার – উত্তর ২৪ পরগণা ও দক্ষিণ ২৪ পরগনার জেলাজজ হয়েছিলেন।সিটি কোর্টের চিফ জাজ ছিলেন একদা।এরপর কলকাতা হাইকোর্টের রেজিস্ট্রার ইন্সপেকশন থেকে রেজিস্ট্রার জেনারেল। তারপর অর্থাৎ ২০২১ সাল থেকে ২০২৩ সাল পর্যন্ত কলকাতা হাইকোর্টের বিচারপতি পদে ছিলেন তিনি। সম্প্রতি হাওড়ার শিবপুরে বিধি ভেঙে একই ফ্ল্যাট একাধিক জন কে বিক্রি করার জন্য অভিযুক্ত প্রমোটার কে মোটা অংকের ক্ষতিপূরণ মেটানোর নির্দেশ দেয় এই আপিলেট ট্রাইবুনাল। কলকাতা হাইকোর্টে যাওয়ার আগে রিয়েল এস্টেট নিয়ে নানান অভাব অভিযোগ জানাবার জন্য কলকাতার সন্তোষপুরে সার্ভে পার্ক এলাকায় রেরার অফিস রয়েছে। এখানে দুটি শাখা রয়েছে। একটি ওয়েস্ট বেঙ্গল রিয়েল এস্টেট রেগুলেটরি অথরিটি , অপরটি ওয়েস্ট বেঙ্গল রিয়েল এস্টেট (আপিলেট) ট্রাইবুনাল। মহানগর কলকাতা সহ রাজ্যের বিভিন্ন জেলার সদর – মহকুমা সদর শহর গুলিতে যেভাবে বেআইনী নির্মাণ, একাংশ প্রমোটারদের গ্রাহকদের ঠকানো প্রভৃতি বিষয়গুলির দৌরাত্ম ক্রমশ বাড়ছে। সেখানে রেরার অফিসে ভুক্তভোগীদের অভাব অভিযোগ জানাবার স্বতন্ত্র ট্রাইবুনাল চালু হয়েছে, তাতে উপকৃত হবেন অনেকেই বলে মনে করছে ওয়াকিবহাল মহল।
Mollah Jasimuddin, not one year – two years, but after almost eight years, was recently appointed as the chairman of the Appellate Tribunal related to real estate in the central law. The conflict between the central and the state over the real estate law was going on for so long. Justice Rabindranath Samanta Mahashay, who has just retired from the Calcutta High Court, was appointed as the Chairman of the West Bengal Real Estate Appellate Tribunal by the Governor on March 20 on the ruling of the Division Bench of the Chief Justice of the Supreme Court. This Appellate Tribunal has given effective judgment in several cases in just two months. It is known that in 2016, the Central Government formed the Real Estate Tribunal (RERA). Although it has been introduced everywhere in the country, the state government has formed its own law (Hira) in this state in 2017. A case was filed in the Supreme Court challenging the state’s real estate law. On May 4, 2021, a three-member division bench headed by Chief Justice Chandrachud declared the state’s Real Estate Act (Hira) unconstitutional under Section 245. At the same time, the Central Real Estate Tribunal issued guidelines for the formation of RERA. In July of that year, the state government issued a notification for the formation of RERA. Former judge Gaursundar Banerjee was appointed as judicial member on December 30, 2022 and IFS Dr. Subrata Mukherjee as administrative member on February 20 last year in this three-member bench. On March 20, the governor appointed retired Calcutta High Court judge Rabindranath Samanta Mahashay K. The West Bengal Real Estate Appellate Tribunal has gained momentum with the appointment of a Chairperson. Justice Rabindranath Samant is a Judicial Officer of 1987 batch. In 1988, he took charge as a judge in the lower court. Later, he became the District Judge of Cooch Behar – North 24 Parganas and South 24 Parganas. He was the Chief Judge of the City Court at one time. Then he became the Registrar General from the Registrar Inspection of Calcutta High Court. Then i.e. from 2021 to 2023 he was the judge of Calcutta High Court. Recently, the Appellate Tribunal ordered the promoter accused of breaking the rules and selling the same flat to multiple people in Shivpur, Howrah, to pay a huge amount of compensation. RERA has an office at Survey Park area in Santoshpur, Kolkata to file complaints regarding real estate before going to Calcutta High Court. There are two branches here. One is the West Bengal Real Estate Regulatory Authority, the other is the West Bengal Real Estate (Appellate) Tribunal. In various district headquarters – sub-divisional headquarters cities of the state including metropolitan Kolkata, the violence of illegal construction, cheating of customers by some promoters etc. is increasing. An independent tribunal has been launched in Rera’s office to complain about the lack of victims, many people in the know feel that it will benefit.
